Votinova is a product developed and operated by Atbion OÜ. It is a software-as-a-service (SaaS) offering for interactive presentations and real-time audience voting (Mentimeter / Slido category).

The Platform enables a presenter (a Votinova customer) to create or import presentations with interactive questions —such as multiple choice, scales, NPS, word clouds, open-ended questions, quizzes, ranking, numerical estimation or heatmaps over images—, to run them live and to have an audience of participants respond in real time, watching the results aggregate instantly onto the slide itself.

Votinova is available through:

• Web application: accessible at https://votinova.com, including the presenter dashboard and the results screen.
• Participant join via web: participants join a session by entering a code or scanning a QR code, with no account required.
• Add-in for Microsoft PowerPoint: to control sessions from within the presentation itself.
• Mobile application for iOS and Android: available on the Apple App Store and on Google Play.

Atbion OÜ provides the software service directly to its customers. Votinova is not a marketplace or an intermediary between third parties: it does not facilitate or manage service-provision contracts between users, nor does it act as an intermediary in payment transactions to third parties. The contractual relationship is established between Atbion OÜ and the customer who contracts the Platform.

The service is intended both for businesses and professionals and for consumers (for example, teachers, trainers or event organisers acting in an individual capacity). The mandatory rights granted to consumer customers under European Union consumer-protection law apply in all cases.

The institutional content of the Platform is the responsibility of Atbion OÜ. User-generated content —the content of the presentations and questions created or imported by the presenter, as well as the open-ended responses, audience questions (Q&A) and contributions submitted by participants during a session— is the sole responsibility of the person who creates or contributes it, in accordance with the Terms of Service and the Content and Moderation Policy.

8.1. Information society service provider

Atbion OÜ is an information society service provider established in Estonia. To the extent that the Platform hosts content provided by users (the content of the presenter's presentations and the participants' contributions displayed to the session audience), Atbion OÜ acts as a hosting service provider within the meaning of Regulation (EU) 2022/2065 (Digital Services Act, DSA).

8.2. Own content

Atbion OÜ prepares and updates the Platform's own content with the utmost possible diligence. Nevertheless, it does not warrant the accuracy, completeness or currency of the informational content published, which is of a general nature and does not constitute professional advice. Atbion OÜ reserves the right to modify, expand or remove any of its own content at any time, without prejudice to existing contractual obligations.

8.3. User-generated content

Atbion OÜ does not generate, monitor in a prior and general manner, or adopt as its own the user-generated content, and is not responsible for such content. Where it receives a sufficiently substantiated notice concerning allegedly illegal content, Atbion OÜ shall act with due diligence to remove it or disable access to it in accordance with the notice-and-action procedure under Article 16 of the DSA, and shall give reasons for its decision in accordance with Article 17.

To report allegedly illegal or inappropriate content, users and third parties may use the reporting mechanisms available on the Platform, the form at https://votinova.com/report or the email moderation@votinova.com. Atbion OÜ shall acknowledge receipt of the notice and adopt a reasoned decision without undue delay. The details of the procedure are set out in the Content and Moderation Policy.

8.4. Transparency reports

Atbion OÜ publishes transparency reports on content moderation in accordance with Article 15 of the DSA. Such reports are available at https://votinova.com/transparencia, in accordance with the schedule set out in the Content and Moderation Policy.

The Platform may contain links to external third-party websites. Atbion OÜ has no control over the content, privacy policies or practices of such websites. At the time the links were created, it was verified that the linked pages contained no manifestly illegal content.

Atbion OÜ assumes no liability for the content of third-party websites linked from the Platform; such liability rests exclusively with their operators. If Atbion OÜ becomes aware that a linked site contains illegal content, the link will be removed without undue delay.

Atbion OÜ's contractual liability towards customers acting as businesses or professionals (B2B) is limited, to the extent permitted by applicable law, to the greater of: (a) the amounts paid by the customer in the twelve (12) months preceding the event giving rise to the liability, or (b) five hundred euros (500 EUR). This limitation does not apply in the event of wilful misconduct or gross negligence, nor to damage to life, physical integrity or health.

With respect to customers acting as consumers, no provision of this Legal Notice limits or excludes the liability of Atbion OÜ to the extent that this is not permitted by mandatory consumer-protection legislation; the consumer's statutory rights remain unaffected.

Atbion OÜ shall not be liable for service interruptions resulting from force majeure, including denial-of-service attacks, third-party infrastructure failures, natural disasters or acts of public authorities.

11.1. Ownership

All of the Platform's own content —including, without limitation, texts, graphics, logos, icons, images, audio and video files, software, source code, the presentation conversion engine, the design of the interfaces, the databases and the structure of the Platform— is protected by applicable intellectual and industrial property law and is the property of Atbion OÜ or its licensors.

11.2. Usage restrictions

Save with the prior written authorisation of Atbion OÜ, or beyond the use expressly authorised in the Terms of Service, it is prohibited to reproduce, distribute, communicate to the public or transform the Platform's own content. In particular, the following is prohibited: applying data mining or extraction techniques (scraping) to the Platform; and decompiling, reverse engineering or disassembling its software, save to the extent permitted by law.

11.3. Trademarks

"Votinova" and "Atbion" are trademarks of Atbion OÜ. Their use without prior written authorisation is prohibited. Any other trademark mentioned on the Platform is the property of its respective owners.

11.4. User content

By uploading or contributing content to the Platform, users grant Atbion OÜ a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display such content for the sole purpose of providing the service (for example, displaying a presentation to the audience or aggregating participants' responses), in accordance with the Terms of Service and the Intellectual Property Policy.

12.1. Applicable law

This Legal Notice and the relationships between Atbion OÜ and the users of the Platform are governed by:

• Estonian law, as the principal applicable law.
• The Estonian Information Society Services Act (Infoühiskonna teenuse seadus).
• Regulation (EU) 2022/2065 (Digital Services Act — DSA).
• The General Data Protection Regulation (Regulation (EU) 2016/679 (GDPR)), as regards the processing of personal data.

12.2. Jurisdiction

For customers acting as businesses or professionals, any dispute arising from the use of the Platform or the interpretation of this Legal Notice shall be submitted to the exclusive jurisdiction of the courts of Tallinn, Estonia (Harju Maakohus), without prejudice to the rules of Regulation (EU) 1215/2012 (Brussels I bis).

For customers acting as consumers, the foregoing does not deprive them of the protection of mandatory provisions or of the jurisdiction of the courts of their country of habitual residence under European Union law.

14.1. Amicable resolution

Atbion OÜ seeks to resolve any dispute relating to the Platform amicably. Complaints may be addressed to hello@atbion.com or to legal@votinova.com, and Atbion OÜ undertakes to respond within a reasonable period. The procedure is set out in detail in the Dispute Resolution Policy.

14.2. Online dispute resolution (consumers)

Following the repeal of Regulation (EU) 524/2013 by Regulation (EU) 2024/3228, effective from 20 July 2025, the European online dispute resolution (ODR) platform has ceased to operate. Consumer customers retain their right to turn to national alternative dispute resolution (ADR) entities and to the competent courts.

Atbion OÜ reserves the right to amend this Legal Notice. Material changes will be notified with reasonable prior notice by means of a publication on the Platform and, where appropriate, by email. Continued use of the Platform after the changes take effect constitutes acceptance thereof, without prejudice to consumers' rights.
